General conditions of Sale
1. General Information and Identification of the Seller
These General Conditions of Sale govern the purchase of products made remotely via the electronic network on the website www.enotecaferrari.com , belonging to Enoteca Ferrari Srl , with offices in Via della Scala, 23 – 37017 Lazise (VR) and in Via Verona, 230 – 25019 Lugana di Sirmione (BS) , VAT number/Tax code 04162280236 , registered in the Verona Companies Register on 02/18/2013 under no. REA VR-397505 , certified email address: enotecaferrari@pec.it , email: info@enotecaferrari.com . By placing an order, the Customer declares that he has read, understood and fully accepted these conditions.
2. Protection of Minors and Sale of Alcohol
In compliance with applicable laws, the sale of alcoholic beverages to minors under 18 is strictly prohibited. Through the Site, the Seller sells its alcoholic products exclusively to adults. By confirming the purchase order, the Customer expressly declares, under his or her own responsibility, that he or she is of legal age (18 years of age or older). The Seller reserves the right not to process orders from individuals who do not meet this requirement.
3. Object of the Contract
Under these general conditions, the Seller sells and the Customer purchases remotely the food and wine products listed and offered for sale on the Site. The contract is concluded exclusively online, through the Customer's placing a purchase order according to the established procedure.
4. Registration and Purchase Procedure
To validly conclude the contract, the Customer must create a personal account during the checkout process, providing truthful information. The sales contract is considered concluded when the Seller sends the Customer an order confirmation email containing a purchase summary.
5. Prices and Payment Methods
All product prices listed on the Site are in euros and include VAT. Shipping costs and any special packaging are indicated and calculated at checkout. Payments can only be made using the secure methods indicated on the Site.
6. Delivery Methods and Times
The Seller will deliver the products via specialized courier. The bottles will be shipped in specially designed packaging (e.g., shockproof wine coolers) to preserve their integrity. Upon delivery, the Customer is required to verify that the packaging is intact. Any external damage (e.g., wet or broken package) must be immediately reported to the courier by marking "Received with reservation due to damaged package" on the delivery note.
7. Legal Guarantee and Defective Products (e.g. “Cork Smell”)
The Consumer Customer is protected by the Legal Guarantee of Conformity (Legislative Decree 206/2005). If the Customer receives a clearly defective wine (for example, a "corked" taste), he or she must report it to the Seller within two months of discovering the defect. To obtain a replacement or refund, the defective bottle must be returned to the Seller with its original cork still intact, with at least three-quarters of its contents intact. The Seller will assess the reported defect and, if confirmed, proceed with the replacement or issue a discount/refund code.
8. Right of Withdrawal and Online Procedure (pursuant to Art. 54-bis and Art. 59 of the Consumer Code)
The Customer has the right to withdraw from the contract, without penalty and without specifying the reason, within 14 calendar days of physical acquisition of the goods.
Digital return procedure: To ensure maximum transparency, the return request is digital. To exercise the right of withdrawal, the Customer must:

Navigate to the “Orders” section and locate the relevant order.

Click on the “Withdraw from the contract here” button.

Submit your declaration using the pop-up form.
Automatic Confirmation Receipt: Immediately after submitting the request, the Customer will receive a receipt on a durable medium at the email address provided, certifying the date, time, and receipt of the declaration.
ATTENTION: Strict conditions for the return of wines and beverages: Pursuant to art. 59, letter e) of the Consumer Code, to protect hygiene and food safety, the right of withdrawal is subject to strict conditions. Returns will be accepted only if the products meet the following requirements:

Bottles, jars, and cans must be perfectly sealed . The cap, lid, or warranty label must not have been removed, opened, or tampered with.

The original labels and packaging must be perfectly intact. The right of withdrawal is entirely forfeited if the bottle, jar, or food packaging is opened or the seal is tampered with after delivery.
Returns, Costs and Refunds: The Customer is required to return the goods to Enoteca Ferrari Srl – Via della Scala, 23 – 37017 Lazise (VR) – within 14 days . The return costs are borne by the Customer. We recommend using secure, break-proof packaging. The Seller will withhold the refund until the goods have been received at the warehouse and the seals have been verified to be completely intact.
9. Applicable Law and Jurisdiction These General Conditions of Sale are governed by Italian law. Any dispute not resolved amicably will be subject to the exclusive jurisdiction of the Court of the Customer's place of residence or domicile, if located in Italy.
10.
